This Privacy Policy dated October 1, 2024, reflects Player Way, LLC’s commitment to and obligations required pursuant to the European Union’s General Data Protection Regulation. Players Way, LLC (“Players Way”), owns and produces www.ThePlayersWay.com (the “Website”). The Website and all materials contained herein are collectively referred to as the “PW Properties” and individually as a “PW Property”.

 

Your privacy is important to us and this Privacy Policy describes what information Players Way collects via PW Properties, how we may use that information and the choices we offer for you to manage the personal information we collect related to your use of PW Properties.

 

  1. PERSONAL INFORMATION WE COLLECT.

Players Way collects the personal information you choose to provide. You may visit the Website and use many parts of PW Properties without disclosing any personal information. However, if you choose to use select, special or enhanced elements of PW Properties, if any such elements are available, you may need to share certain personal information with us so those elements may work properly. When you sign up and create a profile, set up your user preferences, pay for a subscription or use other enhanced PW Properties features, Players Way may collect the following information, including, but not limited to:

  1. HOW WE USE AND SHARE YOUR PERSONAL INFORMATION.

If you submit personal information via PW Properties to Players Way, or to any third party acting on behalf of Players Way (a “Service Provider”), we may use and share your information as set forth in this Privacy Policy, as disclosed when you first submit your information or as otherwise permissible under applicable law. We will not sell, lease, publish or share your personal information with or to anyone else, except as set forth in this Privacy Policy. We may use and share your personal information as described in Section 1 above:

  • To communicate with you about Players Way, its sponsors and promotional partners, and about products, services, sponsors, partners or affiliates related to a purchase you have made or rules or terms to which you have agreed, to the extent the sending of such communication is permissible under applicable law;
  • To send you periodic surveys to help improve Players Way or your Players Way experience;
  • To send you information regarding Players Way including news, updates, services, or programs;
  • When the personally identifying components of your information are removed, we may use and share such anonymized information for internal purposes (e.g., to learn about the age distribution of our users); and

  1. OTHER INFORMATION COLLECTED.
    1. DEVICE INFORMATION. Players Way collects information about the type of device you use to access PW Properties, as well as your device settings, operating system, browser information, connection type, IP address, and the URLs of referring pages. Additionally, we log the date and time you access our services, as well as any error or crash data. We use device and location information to help us optimize your display and performance, understand user demographics, and improve overall user experience. Your log data helps us troubleshoot errors, analyze performance, resolve reliability issues, perform security audits, and investigate potential service fraud or abuse.
    2. SERVICE METADATA. Players Way uses this information to help us understand how you use PW Properties, including links clicked, search terms used, and features accessed. This information is used to measure the strengths of our products, and enhance our services.
    3. Players Way and its third party advertising and analystics partners use cookies and similar technologies to track across different devices, websites and online services. This information is used for secure authentication and for maintenance of your active PW Properties sessions. Third party partners use cookies and similar technologies for the purposes of marketing, advertising, and performance analytics.
    4. LINKED SERVICES/INTEGRATIONS. Whenever you or your account owner links to a third-party service, Players Way is authorized to connect and transfer information as specified by our agreement with that linked service. We use this information to authenticate, connect, or link your third-party accounts to Players Way. We do not receive or store passwords for any of these third-party services. To understand what data may be shared with Players Way when you enable these integrations, please check the settings, permissions and privacy policies of these third-party services.
    5. ACCOUNTS, SUBSCRIPTIONS. Players Way Website team or player profile pages; subscriptions or sales of other goods and services uses forms that may ask you to voluntarily provide us with contact information (such as name, e-mail and postal addresses), payment processing (such as bank or credit/debit card numbers), and demographic information (such as city, state, zip code and age). Contact information from team or player profile pages; subscriptions for services, subscriptions for videos or sales of other goods and services forms are used to contact customers, when necessary. This data is necessary for the processing of, and future identification of, teams, players, subscriptions and sales of other goods and confirmation of mailing addresses, and is used solely for those purposes. Payment Information is never given or sold to third parties for any purpose, except to Players Way and to third-party service providers acting on its behalf. Personally Identifiable Information (PII) may be collected in order to process payments. This information is never made public nor given or sold to third parties for any purpose, except to Players Way and to third-party service providers acting on its behalf or the purpose it was given. Demographic and profile data is also collected at the Players Way Website and PW Properties. This data is necessary for promotion of a player or team and for statistical purposes and is used solely for that purpose. This non PII information may be publicly available to visitors to our site. Players Way may disclose your personal information among its affiliated businesses and with third-party service providers acting on behalf of Players Way. The personal information you provide may be transmitted, used, stored and otherwise processed outside of the country where you submitted that information, including jurisdictions that may not have data privacy laws that provide equivalent protection to such laws in your home country.
    6. No Spyware or Adware. We do not install any Spyware or Adware in connection with PW Properties. We do not distribute any commercial message, or authorize any third party to distribute any commercial message, by means of Spyware or Adware. “Spyware” or “Adware” is any software which has been downloaded to or installed on an Internet user’s computer or device, either without the user’s consent or not in compliance with the applicable website privacy policy, and facilitates the distribution of any commercial message to the user. If you feel you may have spyware from another company installed on your machine, there are various anti-spyware/adware software applications available on the Internet to identify if this has occurred.
  1. INFORMATION SECURITY.

Players Way uses encryption and authentication tools to protect your personal information. The information you may provide through PW Properties is secured using industry-standard security matters to protect the loss, misuse, or alteration of the information under our control. In addition, our employees are instructed that such information is to be used only in accordance with the terms of this Privacy Policy and the laws applicable to each specific business. Employees who misuse customer information are subject to disciplinary action.

 

  1. LINKS

PW Properties may contain links to other sites not monitored by or controlled by Players Way. In addition, if you click an advertisement within PW Properties, you may be directed to a destination within PW Properties or to a third party website or product. Players Way shall not be responsible for the privacy practices or the content of such non-controlled linked websites. This Privacy Policy applies only to the PW Properties, unless you are notified otherwise upon accessing any third party website or product, in which case the terms and conditions set forth in such notification will apply.

 

  1. CHANGE IN BUSINESS

If Players Way engages in a merger, acquisition, reorganization, bankruptcy, dissolution, sale of company assets, financing, public offering of securities, or due diligence and other steps in contemplation and negotiation of such activities, we may share or transfer information that we collect under this privacy policy, subject to standard confidentiality agreements.

 

  1. DATA RETENTION AND INTERNATIONAL DATA TRANSFER

Players Way may retain certain information for as long as necessary in order to support business operations, or as required by law.

Players Way collects information internationally and uses hosting and cloud computing infrastructure located primarily in the United States to transfer, process and store information. In order to provide you with our service, we may also transfer your data to third-party services that are needed for the Players Way services you use, however we will not sell your data.

 

  1. YOUR DATA RIGHTS.
    1. RIGHT TO BE FORGOTTEN. You have the right to be forgotten which means that, at any time, you can request that Players Way permanently delete all applicable data records, including your profile information, along with any user-created content. In some cases, we may need to retain partial information to fulfil our legal responsibilities.
    2. DATA PORTABILITY. You have the right, at any time, to request and receive the information that you have provided to PG. We will provide you with your information, in a machine-readable format, so that you can make use of it in other contexts, or with other service providers.
    3. ACCESS UNDER 16 YEARS OF AGE. Players Way services are not directed at children. Furthermore, we do not knowingly collect personal information from individuals under 16 years of age, unless consent is given or authorized by the holder of parental responsibility over the child. If we become aware that someone under 16 has provided us with personal details, we will take steps to delete such information. If you become aware that a child has unlawfully or unwittingly provided us with personal data, please contact our support team.
  1. ONLINE PRIVACY POLICY ONLY.

This privacy policy applies only to our online activities and is valid for visitors to our website with regards to the information that they shared and/or collect on the Website. This policy is not applicable to any information collected offline or via channels other than on PW Properties.

The Privacy Policy does not apply to other advertisers or websites. You must review the privacy policies of these third-party sites for more detailed information.

If you are a resident of California, pursuant to California Civil Code Section 1798.83, you may request information regarding our disclosure of your personal information to a third party for that party’s direct marketing purposes. California Do Not Track Disclosures. Some web browsers may transmit “do-not-track” signals to websites with which the browser communicates. Our Website does not currently respond to these “do-not-track” signals.

Even if you have previously consented to our Terms of Use and Privacy Policy, you have the right, at any time, to change your mind and object to the collection, use, and processing of your personal information. Additionally, you are under no contractual obligation to continue to provide any information to Players Way. However, we require certain information in order to provide you with our services.

You may choose and control what information you provide about yourself and certain information which is automatically collected via PW Properties. If you do not wish to provide certain information necessary for enhanced functionality or content on PW Properties, please do not use such functionality or content. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows a user to accept or reject most cookies.

Players Way may modify this Agreement from time to time and such modification shall be effective upon being posted on PW Properties. You agree to be bound to any changes to this Agreement when you use PW Properties after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

Players Way reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of PW Properties at any time, for any or no reason, with or without prior notice, and without liability. Players Way expressly reserves the right to remove your profile and/or restrict, suspend, or terminate your access to any part of PW Properties if Players Way determines, in its sole discretion, that you pose a threat to Players Way and/or its users.
